Stephen Lowe
Stephen Lowe focuses his practice in the areas of commercial litigation and construction law. He has represented clients from business sectors such as manufacturing, service, retail and healthcare in resolving business and contract disputes concerning matters such as product defects, facilities management, service contracts and commercial leases. In the construction industry he has represented owners, contractors, design professionals and sureties involved in projects such as airports, sports arenas, hotels, heavy industrial and municipal facilities and office buildings with disputes ranging from delay and impact claims to scope of work disputes, as well as design and construction defects.
Mr. Lowe understands well that disputes can be costly and disruptive to the client’s business and operations, and he works to help his clients avoid that whenever possible by seeking reasonable avenues for negotiation and compromise of disputes. Oftentimes, this produces the best and most cost-effective result for the client. But when settlement is not feasible, he is prepared to vigorously advocate for his client’s interests in court or other forums, and in that capacity he has represented clients in complex dispute resolution proceedings across the country, in both State and Federal courts, as well as in arbitration.
The likelihood that a business will be drawn into litigation, and the likelihood that it will enjoy a successful outcome once in litigation, is often directly related to the clarity and foresight of the contracts it enters into. Mr. Lowe has extensive experience in the review, drafting and negotiation of contracts on behalf of his clients, including service contracts, procurement contracts, partnering agreements and many types of construction industry contracts.
Mr. Lowe believes that candor by both the attorney and the client, coupled with open lines of communication, is essential to a successful attorney-client relationship. He strives to uphold that standard, and welcomes his clients’ input and participation in every engagement.
Mr. Lowe has long held an “AV” rating from Martindale-Hubbell, the highest such rating awarded. He earned his bachelor’s degree from Davidson College (1981) and his law degree from the University of Florida College of Law (1986), where he was a Member of the Editorial Board for the University of Florida Law Review. He is admitted to practice in Georgia and Florida, the U.S. District Courts for the Northern and Middle Districts of Georgia, and U.S. Court of Appeals for the Eleventh Circuit. Mr. Lowe is a member of the State Bar of Georgia, the Florida Bar, and the Atlanta Bar Association.
